In England and Wales the law allows for an individual to pursue a claim by adopting a NO WIN NO FEE agreement with their chosen solicitor.

This phrase is seldom explained clearly because the concept of "no win no fee" does involve a complex and very new area of personal injury law.

If you win your claim - you will receive payment of costs from the losing parties insurers and you will also receive your compensation award. We pay 100% of any award in relation to any accident claim (with just two exceptions - hit & run claims or criminal injury cases).

If you lose - both you and your solicitor will receive nothing.

The solicitor therefore takes on a huge risk because he / she may end up working for absolutely nothing. To accommodate for this your solicitor is entitled to recover a bonus award from the insurers known as a "success fee" if your claim is successful.

This is all very well but people quite rightly worry about LOSING a claim and the costs that might come their way if such a situation arises. A no win no fee solicitor cannot charge you for his time - that, as explained, is part of the deal. But the big worry concerns who pays for the necessary expenses to progress the claim such as medical reporting fees etc? The answer here is simple - insurance.

You can protect yourself by obtaining a policy of insurance that will be recovered in full if you win the claim. This is only necessary where you have no alternative "legal expense" cover with a motor policy or home and contents policy for example. Most people do have cover of this nature.

So the KEY points for you to remember are:

No win No fee agreements are straightforward in many ways

The risk of losing affects your solicitor as much as it does you - work as a team and aim to succeed.

If the worst happens and you lose the case - make sure steps have been put in place to protect your interests (ie insurance) BUT DO BEAR IN MIND THIS COVER DOES NOT NECESSARILY NEED TO BE TAKEN OUT UNTIL A CASE IS LITIGATED
